AQA 63336 Terms and Conditions
These are the Terms and Conditions that apply to delivery and use of the AQA 63336 service (the "Service"). By continuing to use the Service, You are acknowledging and also agreeing with Us that You will be bound by and comply with these Terms and Conditions.

In these Terms and Conditions, the words "We", "Our", and "Us" all refer to IssueBits Ltd., a company incorporated in England, together with its successors or assigns. The Words "You" and "Yours" are references to any person who uses the Service. In other words, You are Our customer and We supply the Service to You.
1. The service description – what We do, and what You do
1.1 We are glad that You have chosen to use the Service. We hope that You find it both fun and useful and We make You this promise: when you submit a question to the Service, We will try to get a correct answer to You quickly.
1.2 We are not perfect and We sometimes make mistakes. For example, sometimes We get incorrect information supplied to Us by another person. In supplying this Service, We assume that: (i) You will only use the Service for entertainment purposes; and (ii) You will not rely upon the Service in making decisions or taking actions that could cost You or any other person their life, health, wealth, or happiness.
1.3 We also do not want people to abuse our Service. You agree: (i) You will not use the Service in violation of any applicable law or regulation; (ii) You will not use the Service for any purpose that would result in, or otherwise be related to, any unlawful activity; (iii) You will not misrepresent Your identity or Your contact details; and (iv) You are fully authorised to employ the payment mechanism used to pay for the Service. We will be relying upon each of these statements from You just as if you repeated them to us every time You use the Service. We reserve the right to suspend the Service or and/or refuse to answer any question if, in Our opinion, We believe there has been a violation of these Terms and Conditions.
1.4 Remember that We are supplying answers to You. If You choose to display or transmit an answer to any other person then You agree to take sole responsibility for the result. You must also comply with the terms of the permission we grant below in the discussion of intellectual property.

3. Intellectual property
3.1 We (and other people who grant licences to Us) own all intellectual property rights that subsist in or arise in the operation of the Service. For example, these include rights in the technology used to compile and coordinate answers, copyright in the answers themselves, database rights in the list of questions and answers that we maintain, our various trademarks, and a whole bunch of other rights we don't want to bore you with. Some of Our technology is subject to pending patent applications.
3.2 When You submit a question to Us and We deliver an answer to You, You (and You alone) have Our permission to take that answer and display or otherwise transmit it to a reasonable number of Your friends, family, and acquaintances. You may not supply that answer as part of a commercial relationship or include it within a commercial publication. You are not allowed to do anything beyond that.
3.3 One of the things that makes the Service fun is Our ability to use and share the questions We receive. When You submit a question, You give Us permission to do anything We choose with the question, subject only to compliance with applicable privacy rules. If You're applying for a job, You also give us permission to do with anything We choose with the content you provide, subject only to compliance with applicable privacy rules. This permission (which our lawyers have asked Us to tell You is a "perpetual royalty-free licence") includes without limitation the right for Us and anyone else we authorise to publish, display, transmit, translate, or create derivations from the question or answer, anywhere in the world, for any purpose, and embodied in any media whatsoever (whether existing now or later invented).
4. Payments
4.1 You agree to pay the fees for any Service requested by You or by any other person who is authorised by You to use Your payment device. The current pricing for the Service can be found here.
5. Termination or suspension
5.1 We do not guarantee that We will continue to supply the Service indefinitely. We can stop supplying the Service at any time without notice, and We reserve the right to refuse to supply the Service to any person.

7. Our liability
7.1 We have described above what You should expect from Us when we supply the Service. The descriptions above are the only promises We make about the Service.
7.2 WE HEREBY EXCLUDE AND DISCLAIM ALL OTHER TERMS AND CONDITIONS THAT WOULD OTHERWISE BE IMPLIED BY OPERATION OF APPLICABLE LAW INCLUDING WITHOUT LIMITATION TERMS CONCERNING SATISFACTORY QUALITY, MERCHANTABILITY, AND FITNESS FOR PURPOSES.
7.3 OUR LIABILITY ARISING FROM OR OTHERWISE RELATED TO THE SERVICE (WHETHER ARISING AS A RESULT OF BREACH OF CONTRACT OR TORT OR BREACH OF STATUTORY DUTY OR ANY OTHER LEGAL OR EQUITABLE BASIS) SHALL BE LIMITED TO THE FEE THAT YOU PAY FOR THE SERVICE UP.
7.4 No exclusion or limitation in these Terms and Conditions limits Our liability as a result of: (i) death or personal injury caused by Our negligence; or (ii) fraudulent misrepresentation. Your statutory rights are not affected.
8. Refund policy
8.1 If for any reason You have an answer that You are unhappy with, You may contact Us to apply for further information or a refund.
8.2 Refund applications must be made by You within 30 days of receiving an answer from Us. We reserve the right to limit refunds to a total of 10 questions per mobile number in any 3 month period.
9. Amendment, assignment, and governing law
9.1 We can amend these Terms and Conditions at any time. We may notify You of the amendment by changing this document on Our web site. Please check back regularly.
9.2 We can assign Our various rights under this agreement to any other person without asking Your permission. Your rights are personal and not assignable.
9.3 These Terms and Conditions are governed by and shall be interpreted in accordance with the law of England. You agree and consent to the jurisdiction of the English courts to resolve any dispute that arises as a result of or in connection with this agreement.

AQA2U Terms and Conditions
The following are the terms and conditions for customers who subscribe to topics provided under the AQA2U service.
By continuing to use the AQA2U Service, You are acknowledging and also agreeing with Us that You will be bound by and comply with these Terms and Conditions.
In these Terms and Conditions, the words "We", "Our", and "Us" all refer to IssueBits Ltd., a company incorporated in England, together with its successors or assigns. The Words "You", "Yours" and "Subscriber" are references to any person who uses the Service. In other words, You are Our customer and We supply the Service to You.
1. Definitions
"Adult Content" means content of an adult nature as that term is commonly understood in everyday language, including without limitation as relates to sexual acts, violence, drugs, alcohol or gambling;
"AQA Club" means the loyalty membership programme operated and run by Us;
“AQA2U Publishing Policy" means the rules which We have established to ensure that Texts comply with the code of practice of the regulator of text services from time to time and do not cause offence, upset or harm to Subscribers;
"AQA2U Service" means the micro-publishing service based on premium rate Texts, operated by Us;
"Confirmation Text" means the Text We send you to confirm Your Subscription to a particular Topic or Topics;
"Content" means all information, data, text, music, sound, photographs, graphics, video and other material included in the Texts;
"Intellectual Property Rights" means copyright, computer code and script in any computer language or program, patents, trade marks and service marks (whether registered or unregistered), trade names, domain names, rights in get-up, inventions, all rights in computer software and data, databases, confidential information, trade secrets and know-how, design rights, registered designs (whether registered or applications), performers rights and forms of protection of a nature or having a similar effect to any of the above, subsisting anywhere in the world;
"Item" means an individual Text within a Topic;
"MMS" means Multimedia Messaging Service;
"Publisher" means a provider of Content for one or more Topics;
"Subscriber" means a person who has signed up to receive Texts on one or more Topics;
"Subscription" means a subscription to receive Texts for a particular Topic until You end it;
"Subscription Request Text" means the text message You send to Us requesting to receive Texts for a particular Topic or Topics;
"SMS" means a Short Message being a message comprising numerals and/or text and/or binary code (including for the avoidance of doubt ring tones, icons and logos);
"Tariffs" means the AQA rate card from time to time, a copy of which is available in Schedule 1;
"Text" means SMS and/or MMS messages sent to Subscribers;
"Topic" means a headline category for a type of Content;
“Unique Topic Code” means the identifier of a Topic which ends with the suffix “2U”, for example "NEWS2U" and "NICE2U";
"Website" means the website located at the URL www.aqa.63336.com or such other website as We operate from time to time.
2. The AQA2U Service – What Publishers Do
Publishers are responsible for the Content of the Topic. They own the copyright for the Content and are responsible for ensuring that:
a) the Content
(i) does not infringe the Intellectual Property Rights of any third party;
(ii) is not defamatory or illegal and does not contain any material which is harmful, threatening, abusive, harassing, vulgar, obscene, or racially or ethnically objectionable;
(iii) does not contain Adult Content; and
(iv) complies with the code of practice of the regulator of text services from time to time.
(v) complies with the AQA2U Publishing Policy.
b) accessing, holding, transmitting or supplying the Content is not a criminal offence or otherwise unlawful;
c) where they are not the owner of copyright in the Content, that the owners have not previously licensed, assigned, or granted the Intellectual Property Rights in the Content to any third party, so as to derogate from Our rights to send it to You;
d) all clearances, licences and consents necessary for Us to send the Content to You without any liability to third parties, have been obtained.
3. The AQA2U Service – What We Do and What You Do
We hope that You find the AQA2U Service both fun and useful and We make You this promise: When You subscribe to the AQA2U Service, We will send You Texts relating to Your chosen Topic or Topics up to the number which We specify on Our Website for that particular Topic until You choose to stop Your Subscription or the AQA2U Service comes to an end for another reason.
In supplying the AQA2U Service, We assume that You will not rely upon the AQA2U Service in making decisions or taking actions that could cost You or any other person their life, health, wealth, or happiness. We and Our Publishers (being those people whose Content We publish) shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via Texts and shall not be responsible or liable for any trading or investment decisions based on information in Texts.
We have a responsibility to ensure that the AQA2U Service complies with the code of practice of the regulator of text services from time to time and so have developed the AQA2U Publishing Policy which all Publishers of Content must adhere to. A copy of the AQA2U Publishing Policy is available on our Website.
THE PUBLISHERS ARE SOLELY RESPONSIBLE FOR THE CONTENT AND WE DO NOT CHECK IT IN ANY WAY, OTHER THAN FOR COMPLIANCE WITH THE AQA2U PUBLISHING POLICY.
We also do not want people to abuse our AQA2U Service. You agree: (i) You will not use the AQA2U Service in violation of any applicable law or regulation; (ii) You will not use the AQA2U Service for any purpose that would result in, or otherwise be related to, any unlawful activity; (iii) You will not misrepresent Your identity or Your contact details; and (iv) You are responsible for or have the permission of the person responsible for paying for the use of the mobile phone or device to which the AQA2U Service is delivered. We will be relying upon each of these statements from You just as if You repeated them to Us every time You use the AQA2U Service. We reserve the right to suspend the AQA2U Service if, in Our opinion, We believe there has been a violation of these Terms and Conditions.
Remember that We are supplying Texts to You. If You choose to display or transmit any Texts to any other person then You agree to take sole responsibility for the result. You must also comply with the terms of the permission We grant below in the discussion of intellectual property.
4. Starting, Stopping and Amending Your Subscription
To start the AQA2U Service You will need to send a text message to 63336 quoting the Unique Topic Code of the Topic You wish to subscribe to. We will send You a Text free of charge confirming receipt of Your subscription request and the Topic You have subscribed for.
You can stop Your Subscription at any time by sending a text to 85558 with the word "STOP" followed by the Unique Topic Code, or "STOP" or "STOP ALL". Alternatively You can stop the AQA2U Service by using the facility within the AQA2U section of Our Website.
You are responsible for providing and maintaining a mobile phone and ensuring connection to a network capable of receiving Text services. You understand that if Your mobile phone is switched off or is out of coverage for a period of 7 days or more, or you have insufficient credit, Your network provider may not be able to deliver any Texts to You.
By submitting a Subscription Request Text You confirm that You are the owner or legitimate user or that You have the consent of the owner or legitimate user of the mobile phone or device You are registering to receive the Texts on the Topic from the AQA2U Service. By sending a Subscription Request Text, You are making an offer to take out the Subscription You have specified. All such offers are subject to acceptance by Us. Our acceptance of such offers is subject to these Terms and Conditions.
5. Your personal information

6. Intellectual property
We (and other people who grant licences to Us) own all Intellectual Property Rights that subsist in or arise in the operation of the AQA2U Service. 7. Payments
You agree to pay the fees for the Subscription. The current pricing for the Subscription are set out in Schedule 1.

We do not guarantee that We will continue to supply the AQA2U Service indefinitely. We can stop supplying the AQA2U Service at any time without notice, and We reserve the right to refuse to supply the AQA2U Service to any person.
You agree that the AQA2U Service will start on the day We send You the Confirmation Text. Once the AQA2U Service has started any rights to cancel the AQA2U Service that You would otherwise have had under the Consumer Protection (Distance Selling) Regulations 2000 are waived. If You choose to cancel or stop the AQA2U Service at any time You will be charged the cost of Your Subscription Request Text and any Texts received by You on and prior to the date You cancel or stop the AQA2U Service.

SCHEDULE 1 - Tariffs
The Subscription Request Text sent by You to Us which starts your Subscription to the AQA2U Service will cost 98 pence. Following this We will send You a Confirmation Text which You will not be charged for. Each subsequent Text received by You from Us will cost You 25 pence.
We may also send you free of charge from time to time additional Texts which do not relate to the Topic but which keep you informed of Your Subscription and details of the AQA2U Service, [such as new features and functionality].
The cost of the Text sent by You to the number 85558 to stop the AQA2U Service will cost you the price of a standard text message. Please note that You can also terminate Your Subscription to the AQA2U Service by using the facility within the AQA2U section of Our Website, as described in Clause 4.
SCHEDULE 2 - AQA2U Service Description
1. Starting Your Subscription
You can start Your Subscription to the AQA2U Service by texting the topic name to to 63336. Eg text NEWS2U to 63336.
It costs 98p to subscribe to any Topic.
2. Stopping Your Subscription
You can stop Your Subscription to the AQA2U Service by sending a text to 85558 (standard rate charge applies) in the following formats:
- Texting STOP and the Topic Code stops the Text by Topic - eg text STOP news2u to 85558
- Text STOP: Stops the Topic You last received an Text from
- Text STOP ALL: Stops all Topics you are subscribed.
You can also stop the AQA2U Service at any time by
- Sending a text to 63336 in the format above (costs 98p); or
- Logging into the AQA2U section on our Website here.
